Terms and conditions:
Daily Prompt (the “Daily Prompt Website”, the “Website”, or the “service”) and our mobile application (the “Mobile Application”), (collectively, the “Platform” or the “Daily Prompt Platform”), are an online platform for authors to share, review and promote their writings. Please take a few minutes to read the following so that you understand the rules of the road before starting to use the service.
1. General Terms
By downloading or using the Mobile Application, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re
not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Daily Prompt Limited.
Daily Prompt Limited is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any
time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
2. Accounts
Your Account is personal to you. You are solely responsible for the activity that occurs on your Account, so you should keep your Account password secure. Please notify Daily Prompt immediately of any unauthorized use of your Account. You are not allowed to use any other user’s Account. You do not need to sign up for a user account (an “Account”) in order to access the parts of the Mobile Application that are available to the general public. However, some parts of the Mobile Application are restricted to users with Accounts. In order to access those parts of the Mobile Application, you will have to create an Account.
By creating an Account you are representing that (a) all registration information you submit is truthful and accurate and (b) you are at least 13 years old.
3. Personal Data
The Platform stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the
process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Mobile Application won’t work properly or at all.
4. Publications
In using the Platform you will be able to submit stories and other writings that you have created for posting on the Platform (the “Publications”). By submitting any Publication to us, you represent that (1) the Publication is your original work of authorship and (2) the Publication complies with Daily Prompt’s Content Policy which is described below. You are solely responsible for your own Publications and the consequences of posting them on the Platform.
You expressly acknowledge and agree that once you submit your Content for posting on the Platform, it will be accessible by others, and that there is no confidentiality or privacy with respect to such Content, including, without limitation, any personally identifying information that you may make available online. However, if the Platform provides you with the option of limiting the sharing of a particular piece of Content at a particular time by making it private, Daily Prompt will honor the option you have selected for that specific Content at that time, but any such selection shall apply only to that Content and not more generally to all of your Content across the Platform.
Unless otherwise provided in the terms and conditions of a Special Promotion, you will retain all of your ownership rights in your Content. By submitting content to the Platform, you do, however, grant us rights to display such content on the Platform. The above license granted by you in Publications will terminate within a commercially reasonable time after you remove or delete your Publications from the Platform or deactivate your Account. You
understand and agree, however, that Daily Prompt may retain, but not display, distribute, or perform, server copies of your Publications that have been removed or deleted. The above license granted by you in Content other than Publications (for example, user comments and reviews) is perpetual and irrevocable. Daily Prompt will not use your Publications in an anthology without your prior, written permission.
Daily Prompt has no obligation to post any Content that is submitted to the Platform. Daily Prompt has the right, but not the obligation, to review the content of the Content, and may remove any Content from the Platform at any time at its sole discretion.
Daily Prompt does not endorse and is not responsible for the content of any Content. You understand that when using the Daily Prompt Platform, you will be exposed to Content from a variety of sources, and that it is possible that you may find such Content to be
objectionable. If you believe that any Content does not meet the requirements of Daily Prompt’s Content Policy, please let us know and we will investigate the matter.
5. Content Policy
You will not submit any Publication or User Community Content (collectively, “Content”) to the Platform that:
● contains defamatory or libelous material;
● promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
● harasses or advocates harassment of another person;
● promotes illegal activities or conduct;
● contains any telephone numbers, street addresses or email addresses of any individual;
● violates any copyright or right of publicity or privacy; or
● is contrary to any applicable law.
6. Sharing content
Sharing your content is encouraged, however, we do have some advice about sharing image content outside of the Daily Prompt platform.
If you see an image that is from Unsplash, this is an open source domain and you may include this image alongside your stories on any personal sharing pages. It is respectful to include the name of the photographer, which you can find with the prompt.
